1. Introduction
These Terms & Conditions apply to all services, products, quotations, invoices, and transactions provided by Gill Tech Services (“we”, “us”, “our”) to customers (“you”, “your”).
Gill Tech Services is a trading name of NZ GILL ENTERPRISE LIMITED.
By requesting a quote, accepting services, making payment, or continuing to use our services, you confirm that you have read, understood, and agreed to these Terms in full.
2. Quotes & Pricing
- Pricing is based on information available at the time of quoting
- Prices may change due to supplier, licensing, stock, or exchange rate variations
- Orders are only confirmed after written approval or payment
- We reserve the right to adjust pricing before confirmation if supplier costs change
- All prices are exclusive of GST unless otherwise stated
3. Orders & Payment
- Payment terms are strictly as stated on invoices
- Full or partial prepayment may be required before work begins
- Ownership of goods remains with us until full payment is received
- Late or non-payment may result in suspension or cancellation of services
- Work will not proceed or continue if outstanding invoices exist
- Recovery, legal, or debt collection costs incurred in recovering unpaid invoices may be charged to the client
4. Supply of Products
- Products are supplied via authorised distributors
- Delivery timeframes are estimates only
- We are not responsible for supplier or courier delays
- Risk transfers to the customer upon delivery
5. Change of Mind Returns
We do not offer refunds for change of mind once an order is confirmed, processed, customised, or delivered.
All sales are final unless required under New Zealand consumer law.
6. Consumer Guarantees Act (CGA)
We comply with the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
If a product is:
- Faulty
- Not as described
- Not fit for purpose
You may be entitled to repair, replacement, or refund where required under New Zealand law.
7. Warranty
- All products are covered by manufacturer or distributor warranty only
- No additional warranty is provided by us unless stated otherwise in writing
- Warranty does not cover misuse, accidental damage, liquid damage, power surges, or incorrect installation
- Proof of purchase is required for all claims
8. Returns (RMA Required)
All returns must be approved before being sent.
Process:
- Contact us with invoice and issue details
- Receive Return Material Authorisation (RMA)
- Return item as instructed
Do not return goods without approval.
9. Non-Faulty Returns
If approved (at our discretion):
- Items must be unused, unopened, and in original packaging
- Customer pays return shipping
- Restocking fees may apply
- Special order items are non-returnable
10. Refunds
If approved:
- Refunds are processed to original payment method
- Processing time is typically 5–10 business days
- Payment processing fees may be deducted where legally permitted
Hosting, domain registration, subscription, cloud, licensing, and email service fees are non-refundable.
11. Account Security
Clients are responsible for maintaining the confidentiality and security of passwords, systems, email accounts, and login credentials.
Gill Tech Services is not liable for unauthorised access caused by weak passwords, credential sharing, phishing, malware, or client negligence.
12. Privacy
We comply with the Privacy Act 2020 (New Zealand).
Customer information is used only for service delivery, billing, support, and legal obligations.
13. Force Majeure
We are not liable for delays or failures caused by events outside our control including:
- Supplier delays
- Natural disasters
- Power outages
- Internet outages
- Cyber attacks
- Government actions
- Third-party service failures
14. Governing Law
These Terms are governed by the laws of New Zealand.
15. Shipping Policy
We aim to process and dispatch orders once full payment has been received and cleared. All orders are shipped using trusted third-party courier services, and delivery timeframes are estimates only and may vary. While we take care in packaging and dispatch, responsibility for delivery transfers to the courier once goods have been collected from us. We are not liable for delays or loss caused by third-party delivery providers; however, we will assist customers with tracking and reasonable support for courier claims where applicable. This policy operates in accordance with New Zealand consumer law, including the Consumer Guarantees Act where applicable.
16. Acceptance
By engaging our services, accepting a quote, making payment, or continuing to use our services, you confirm full acceptance of these Terms & Conditions.
